**ITHACA, N.Y.** – The Tompkins County district attorney said on Monday that he would present evidence to a grand jury in a 2024 sexual assault case involving seven former members of Cornell University's Chi Phi fraternity, two years after his office declined to file charges. The decision followed a civil lawsuit filed this month by a former Cornell student, identified in court papers as Jane Doe, that drew national attention to the case. The seven men, referred to online as the "Cornell Seven," have not been charged with a crime.

Since the district attorney's announcement, New York Gov. Kathy Hochul has called for an independent review of Cornell's handling of the case, the state attorney general's office has confirmed its own review, and Ithaca's mayor has proposed pausing permits for student events.

A student columnist at The Vanderbilt Hustler called for a full criminal investigation and charges if the evidence supports them. Fox News highlighted a defense attorney's argument that attention should focus on whether Cornell and prosecutors mishandled the case in 2024\. Ground News also flagged commentary by ABC's Sunny Hostin questioning media accuracy on New York consent law, and the criticism her remarks drew. According to Ground News, only three of the 234 outlets emphasized in their headlines that no charges have been filed.

## What the Lawsuit Alleges

The 101-page complaint, filed Sept. 16 in New York State Supreme Court, names more than a dozen defendants, including the seven former fraternity members, Cornell, the Chi Phi fraternity and its house corporation, the Delta Delta Delta sorority and Moonies Bar & Nightclub, according to CNN and CNY Central.

Ms. Doe, who was 20 at the time, alleges that on the night of Oct. 19, 2024, she went to the Chi Phi house to visit a friend after drinking at her sorority house and a bar. The lawsuit says she had consumed about 10 drinks in three hours, was pressured into taking ketamine and was sexually assaulted by multiple men over several hours while unable to consent, NPR and CBS News reported. The complaint also includes a screenshot of a fraternity group chat on Snapchat that, according to the lawsuit, invited other members to the room.

The lawsuit accuses Cornell of negligence and breach of contract, alleging the university knew or should have known about drug use at the chapter. It accuses the bar of serving alcohol to an intoxicated minor. Ms. Doe is seeking compensatory and punitive damages in an unspecified amount, CBS New York reported. She left Cornell after the alleged assault.

## How Cornell Handled the Case in 2024

Ms. Doe reported the incident to the Cornell University Police Department on Nov. 8, 2024, according to the complaint. The university placed the chapter and the seven students on interim suspension and opened a Title IX investigation that included at least 12 hearings, The Hill reported. The chapter was closed and remains barred from campus.

The lawsuit says some of the students were allowed to reduce their sanctions by writing essays. Ms. Doe's attorney, Thomas Giuffra, told CBS News that two of the seven were expelled and the others received lesser sanctions, including suspensions, workshops and essays. In a statement on Monday, Kyle Kimball, Cornell's vice president for university relations, said essay writing was not offered to anyone as the "sole consequence," confirmed that expulsions and suspensions were issued and said federal privacy law prevents the university from describing individual discipline, according to The Cornell Daily Sun. Cornell also said it formed a sexual assault task force after the incident and has adopted several of its recommendations.

## The District Attorney's Account

In a written statement released Monday, District Attorney Matthew Van Houten said campus police asked his office in November 2024 to review a six-page sworn statement from Ms. Doe. He said that statement did not allege she had been drugged against her will or raped, and that it described her drug use and sexual activity as "voluntary, conscious, and consensual." He said several prosecutors and investigators concluded the facts as written did not meet the legal definition of a crime, and that neither Ms. Doe nor her attorneys contacted his office afterward.

Mr. Van Houten told ABC News that his office relied on the campus police investigation and did not investigate independently, which he described as common for campus cases. He said his office never received the Snapchat screenshot, which he described as vulgar but unrelated to the question of consent. He also said he considers Ms. Doe credible and hopes to bring the case before a grand jury within about 45 days, CBS News reported. A senior prosecutor has been assigned to prepare it.

## The Interview Transcript

On Tuesday, CBS New York reported on a transcript of Ms. Doe's November 2024 interview with campus police, obtained from a source. In it, she told the investigator, "I can say with 100% confidence I was raped." A Title IX investigator, a victim advocate and an adviser were also present, according to MS NOW.

Mr. Van Houten said his office received only the signed statement and never saw the transcript. He said the new information changes his view of the case and that if the full account did not reach his office in 2024, "that's a travesty, and that's a disservice to Jane Doe." He also noted that he considers "raped" a legal conclusion rather than a factual description.

A Cornell spokesperson said campus police shared all investigatory information with the district attorney's office, according to CNN. Mr. Giuffra, Ms. Doe's attorney, said he and his client have no confidence in Mr. Van Houten's handling of the case and that his client was never contacted by prosecutors or investigators trained to interview sexual assault survivors, CBS News reported.

## The Messages Circulating Online

Two sets of messages have spread widely on social media since the lawsuit was filed. The first is a screenshot from a fraternity Snapchat group chat included in the complaint. The lawsuit says it was sent while Ms. Doe was in the room and that it invited other members to join, CNN reported. Sourced is not reproducing its wording. CBS New York said it also obtained video of the group conversation.

Mr. Van Houten said his office did not see the screenshot in 2024 and described the messages as vulgar but unrelated to whether Ms. Doe consented, ABC News reported. Jeremy Saland, who represents one of the defendants, called them inappropriate but said they are not evidence of an assault. Danny Cevallos, a criminal defense attorney and NBC News legal analyst, told NewsNation the messages would likely be admissible as evidence but do not by themselves prove rape, according to The Hill.

The second set surfaced on Tuesday, when CBS New York published screenshots, obtained from a source, of texts it said Ms. Doe and one of the defendants exchanged two days after the alleged assault. In them, the man apologized, said his memory was unclear and said he and another man felt bad for being too intoxicated to stop the situation before it got out of hand. Ms. Doe replied that her memory was also clouded and wrote that none of the sexual activity had been illegal.

Mr. Giuffra confirmed that his client exchanged texts with the defendant shortly after the alleged assault but said he could not confirm these were the same messages. He said she was traumatized and in denial at the time, was trying to learn what happened and avoided an aggressive tone because she wanted answers. He said he understands the texts were presented during Cornell's Title IX proceedings and noted that the defendant was later expelled.

## What the Accused and the Fraternity Say

Three of the seven men have denied the allegations through their attorneys, ABC News reported. Mr. Saland told CNN that his client was not charged in 2024 because the events Ms. Doe alleged did not happen. He has said his client welcomes the grand jury review. Andrew Miltenberg, who represents another defendant, told CNN the allegations now being made publicly differ from what was reported and investigated at the time. CNN reported it was working to determine whether the remaining men have legal representation.

Chi Phi's national organization called the allegations deeply concerning and declined to discuss specifics, citing the pending litigation, according to NBC News and CNN. Trey Robb, the fraternity's interim executive director, said all of the accused members were removed from the Cornell chapter within three days of Ms. Doe's 2024 police report, ABC News reported.

## State and Local Response

Ms. Hochul said on Tuesday that she supports the decision to reopen the criminal case, called the allegations "nothing short of horrifying" and asked that outside counsel review whether Cornell met its obligations to its students, NPR reported. A spokesperson for Attorney General Letitia James confirmed that her office is also reviewing the university's response, according to PIX11\. Sen. Chuck Schumer called for an investigation as well, CBS New York reported.

On Wednesday, Ms. Hochul, who sits on Cornell's board of trustees, told ABC News that the university had agreed to an independent outside investigation of its response. Cornell confirmed the review but had not released details as of Wednesday evening.

Ithaca Mayor Robert Cantelmo, a Cornell alumnus, proposed a moratorium on permits for student and Greek life events until Cornell reviews its sexual violence protocols and releases new safety standards. He said university officials did not notify the Ithaca Police Department in 2024, and the department said it was unaware of the allegations, according to WRVO and CNY Central. The moratorium requires a vote by the Ithaca Common Council. Cornell said it shares the mayor's interest in student safety and would work with him.

Cornell has said it supports the district attorney's decision to send the case to a grand jury.

## Public Reaction

The case has drawn heavy commentary on social media, with many posts criticizing Cornell and the district attorney's office and some questioning the lawsuit's allegations, The Associated Press reported. Several individuals and the student newspaper have published the names of the seven men, and a former television writer has launched a website collecting materials about the case, according to Slate and The 19th. Sourced is not naming the seven men, who have not been criminally charged.

Cornell's Student Assembly has scheduled a public hearing on sexual violence, according to The Cornell Daily Sun.

## What Comes Next

Mr. Van Houten said his office will meet with Ms. Doe before she testifies, has asked for Cornell's Title IX records through her attorney and has suggested some former fraternity members may also testify. A grand jury may consider the charges described in the civil complaint as well as others, he told CBS News. The civil case, Cornell's independent review and the attorney general's review are proceeding separately.
